Terms of Use & Operational Integrity
These Terms govern your access to SucceedHost.com and the high-performance business assets engineered by James Wheeler ("SucceedHost").
1. Engineering & Intellectual Property
The Forge (UI/UX): Unless otherwise agreed in writing, clients retain ownership of the custom visual interfaces and content specifically created for their business.
The Fortress (Kernel): The proprietary PHP kernel, security architecture, and "Secure-by-Design" methodologies used to power our services remain the exclusive Intellectual Property of SucceedHost. Clients are granted a non-exclusive license to use this infrastructure during the term of their active management agreement.
2. Managed Services & Operational Integrity
SucceedHost provides "Managed Operations" rather than commodity hosting. This includes:
- Active forensic monitoring and cryptographic nonce management.
- Zero-Framework-Tax optimization for sub-second load times.
- Immutable backup rotations and kernel-level hardening.
Failure to maintain an active Management Agreement may result in the suspension of proprietary security updates, leaving the asset in an "unmanaged" state.
3. Acceptable Use & Security
You agree not to attempt to reverse-engineer the "Fortress" infrastructure or bypass the security nonces provided. Any attempt to exploit or probe the system's defensive layer will result in immediate termination of services.
4. AI & Automation
Our AI solutions utilize private endpoints. Your data is processed in an ephemeral state and is never used to train public models. SucceedHost acts as a technical buffer between your data and third-party LLM providers.
5. Limitation of Liability
While SucceedHost engineers systems to be "defensible," no digital asset is 100% impenetrable. SucceedHost shall not be liable for losses arising from client-side security failures (e.g., leaked administrative credentials or social engineering).
6. Governing Law
These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved in the jurisdiction of Las Vegas, Nevada.
